I don't think so. And neither is the instance of gear recovery by the OP.
If I was still at the crag? Yes that would be theft. If I was no longer at the crag and I "inadvertently" left some litter (I mean, "gear") behind? No, that would not be theft, that would be a public service. The rules of booty are clear. If you find it laying around and no one is around to claim it, and it wasn't part of a (self)rescue, it's trash and therefor it's yours to decide if you want to keep it or send it back to the previous owner if possible, but the decision to send it back to the previous owner has nothing to do with the rules of booty, only one's personal decisions as to what to do with their newfound gear. And if one does send it back to the previous owner, that's altruistic because you're not sending them their gear back, you're sending them your gear. I miss the days when lost gear posts were "Booty alert! There's fixed gear on X climb or at the base of X climb. If you want to send it back, sweet, otherwise happy hunting!" I recently had a climber contact me when they found a bunch of gear my second had left on the route. As far as I was concerned, that gear belonged to the climber that found it, but they wanted to give it back. It wasn't required, but still pretty awesome.

I don't think so. And neither is the instance of gear recovery by the OP. Whoa, Brohan McHighhorse. Ultimately, its booty rules. It wasn't a fucking rack captain exaggerator. Someone fucked up and dropped or left a piece of gear. Booty rules per this example: he can keep it with no ill conscience, or try and help the gear find its way back to the OG owner and get all those DoGooder points.

And that's why Shawn did nothing wrong when he took people's stashed ropes, right Captain Runon? I mean, I trust the OP to recognize booty when he sees it. I'll believe the gear he's got is booty at least as much as I believe he's got it. But 'anything still at the crag when the party is gone,' is not the rules of booty.

If you have to look for it because it was stashed then it's not laying around now is it? Shawn was not "cleaning" up ropes that were left out in the open (stick clips excepting) so the comparison doesn't really track with the conversation. Try to keep up and work on that reading comprehension. People are welcome to argue that caches are intentional trash because they (generally) go against the regs in a park but imo, you should leave any cache that you have to search around for since those caches are part of the reason there's fun routes to play on for all of you climbers that don't bother to put your own routes up. A thing is either “perfectly clear” and has a concise definition, or it’s one of those “ya know it when you see it” kinda of things. I’m sure it’s just my poor reading comprehension that gives me trouble with your run on sentences, but I’m still hearing a whole bunch of “excepts.” Sure seems to me like a “ya know it when ya see it” kind of thing.
