suing your partner

Any tales of an individual getting sued for negligence in an outdoor climbing scenario? If your partner was negligent and you were hurt, would you sue? I'm talking about two individuals here, not gym/classes/guides/etc. Hoping this has never happened, but I'm curious. |

I sure wouldn't, it's a partnership, after all. It's on me to pay attention also. Now, if you kill someone, would/could their family sue you? Maybe. I can tell you, that when I climb with friends who have kids? It is explicitly understood that I am happy to belay mom...or belay dad. But it is up to them to watch their kid and/or belay them. That party of three works really well, though, and lets parents get out. I have belayed kids in the gym, a very few times, but with their (nonclimbing) parent right there. H. |

The original link is now paywalled, but as I recall from reading it a while ago, dude got a belay from a stranger in a gym, stranger dropped him with serious injuries resulting, stranger sort of disappeared but eventually came back and made good on some payments to help dude with his medical bills. Regarding suing a partner in general...I think everyone talks big ethics, but I think some of that talk would change in the face of serious debilitation, serious partner negligence, and serious medical bills. Genuine desperation changes "the rules," whether we like it or not. |

There was a lawsuit ten or more years ago in the SLC area in which a guy took a girl toproping for a date, he set up a TR with the rope running directly through the webbing (no biners or rings), and it sawed through, severely injuring the girl. She sued successfully. Those are the only details I recall, and google has not been successful. |
