The County and Gypsum recognize that through this Agreement there are no guarantees, commitments or binding obligations by County to approve a Major Project application, or to approve any uses or increased densities proposed by Gypsum as part of any Major Project application and that the County retains discretion regarding any application submitted by Gypsum as a result of this Agreement" I'm going to spend tomorrow researching Chapter 30.20 of the Clark County Code which seems to be the residing law over major project application. |

Spread the word beyond the climbing community, if your work place will let you post up the links and ask your co workers to help out. I work in restaurants and did just this and the response was great. It's an easy way to get more people involved even if they aren't climbers or red rock regulars, every email counts and the more diverse the opposition the better. |

As you may know, in 2003, both the State of Nevada and Clark County adopted laws preventing landowners from applying for zone changes that increased density within the Red Rock Overlay District. The applicant filed lawsuits against both the State of Nevada and Clark County alleging that these laws were in violation of the constitutional right to equal protection under law. In 2009, the Federal Court struck down the State Law as unconstitutional. In 2010, as a result of the Federal Court's decision, Clark County approved a settlement agreement allowing the applicant to apply within a permitted portion of preapproved Exception Areas within the Red Rock Overlay to be planned as a Major Project. The initial step of this Major Project is the submittal of a concept plan, which is now being considered. The Board of County Commissioners is scheduled to hear the concept plan at our August 17th meeting. As you may know, I was elected into office several months after the Board of County Commissioners agreed to the settlement agreement. I am currently reviewing all matters related to the lawsuit and settlement agreement at this time. It seems that the Board continues to have a great amount of discretion over what is ultimately planned within the Red Rock Overlay District. I recently heard back from one of the commissioners who is against it. Write them all but specifically write this one too asking for other ways to make an impact with the others. |
