They are still taking orders at grivel.us
(which has the grivel-us.com text still on it)

I've been exchanging messages on ebay with grivel-us
He is really slimy sounding...i.e. he responds like a con man, not like a normal ebay seller.

The domain for grivel.us was registered on May 16 this year

to
Roberto Grivel
4505 Honeywell Court (Door 31)
Dayton OH

The 4505 Honeywell Court (Door 31) address is apparently the subject of other complaints on ebay (when you google it). Some kind of freight aggregator address.

I think "Roberto Grivel" is an alias

The guy at grivel-us on ebay that's messaging me (I'm accusing him of being a fraud..surprisingly he keeps replying to me...but not identifying himself)

He just says his first name is Roberto.

On one of the products on Ebay from grivel-us, the location was given as Dayton OH. Mostly they say Sandy, UT.

The article on the court order say they are prohibited from arranging merchandise for sale on the internet, including Ebay.

If they are operating out of Ohio, they are trying to avoid the Colorado AG. Man this is awesome. Best thread ever on MP.

I'm from Ohio.

I'll handle this.

Just for insight, Here's the message exchange I had with him on ebay.(at bottom)

The background:
I have an ebay search for Grivel Salamander XL helmet. They're not available anywhere in the world. A hit came up, but it said XL black.
Grivel never made an XL black. They are only titanium.

I exchanged the first couple messages questioning black. You can see his slimy replies. Then surprisingly, I got another hit. He put up an ebay ad for a titanium xl. (both are still there I believe).

I didn't know at this point he was a scammer. Rather than bidding, I found grivel.us and ordered the titanium XL with paypal. Then I found mountainproject thread. I sent email asking grivel.us to cancel and at the same time started exchanging more message with grivel-us on ebay, basically telling him I was clued into his scam...and that it's impossible for him to get a titanium XL helmet anywhere in the world (and very unlikely he has one in stock)

It was late at night, and amazing to me that he kept responding while I basically accused him of fraud repeatedly.

here is the ebay messages. I removed my email address in one message.
It's funny, he cancelled the paypal of mine to grivel.us, at the same time I was harassing him on ebay grivel-us

Last to first:

New message to: grivel-us
I posted a message to the thread on mountain project that warns about you, grivel.us and grivel-us

grivel-us
Since when is it a crime to have Roberto as first name?
where is your point ?
if you want to buy this item feel free to place a bid , if you are not confident on this auction, don't bid on.

levitation30:
Oh Roberto?
like in Roberto Grivel?
that sounds like an alias
and the address 4505 Honeywell Court (Door 31) in Dayton OH is some kind of freight aggregator?

grivel-us
once again, there is nothing we can do, you still don't have purchase this item from eBay,
if you bought this item on a different website you have to contact this third party directly
and to answer at your question my identity is clearly mention on EBay. my first name is Roberto .

levitation30:
I think the right thing for me to do, is to address my concern to the Attorney General in Colorado, Cynthia Coffman and to Ebay, about how you are violating a court order to not sell merchandise on the internet.

If you're so confident about your product, why don't you identify yourself?

grivel-us
if you have order this item on a different website you have to address your concern or comment where you have place your order.

levitation30:
I ordered the titanium XL helmet which you put up on ebay after my comments about the black xl not existing.
I ordered it from your grivel.us website, using paypal.

I sent you email from .... at .... asking you to cancel the order, because I don't believe you have the helmet to sell, and you can't get it.

Can you confirm that you have cancelled that order? Or send email to .... at .... replying to my request to cancel the order.

It's not worth debating your knowledge about Grivel product vs my knowledge any more. I just want that order cancelled.

If you are neither of the parties I mentioned, could you tell me your name? My name is Kevin Normoyle.

thanks
-kevin

grivel-us
on our end we can see this option color, maybe you cannot see it due to geographic restriction on Grivel website.
for another question, no idea what you talking about .

levitation30:
Hi
I looked at that link. I can only find the color titanium for XL

Are you connected with Olivier Goumas, Anna Sofia, 123Mountain, or grivel-us.com ?
I ask, because they are under court order to stop accepting any order for merchandise via the internet, as of April this year.

denver.cbslocal.com/2016/04…
"The court also prohibits the Goumases from setting up online shops on Facebook, Craigslist, EBay and other online sites."

grivel-us
yes
here :
grivel.com/products/ice/hel…
and under Slamader xl you will see black and titanium

levitation30:
okay.
I checked grivel.com/products/rock/he… and the info tab there
it says titanium for the xl, and 8 colors for the normal salamander.
Is there another link I should check?

grivel-us
look like your information are not correct
lot of thing exist outside US, you can check by yourself on grivel Eu website

levitation30:
I thought the Grivel Salamander XL only came in color titanium, not black. Are you sure this is an XL? Can you add a photo showing the helmet marked as XL?

thanks

----------------
(edit)
This is the email I sent to grivel.us to cancel my order. It was cancelled with no reply. This was sent in parallel to the ebay exchanges, using the email address I used on the order. I included the paypal transaction info also
I sent this to cs@grivel-us.com which was on the paypal transaction.

Hi
I just ordered a Grivel Salamander XL Titanium helmet
from your web site today.
I would like to cancel the order, because I don't
think you actually have the helmet in stock, to ship to me.

Let me know about cancellation. Or if you actually
have the helmet in stock and can ship. Grivel in
Europe has none of this helmet, so unless you have it
in stock, you can't get it from anyone.

Thanks,
Kevin Normoyle

This is awesome information. Thanks for the sleuth work and postings. I've interfered with the Colorado AG in their prosecution of these individuals (and was privileged to testify against them on Apr. 6), and I'll shoot my contacts there this information. If the people from 123Mountain are continuing e-commerce, they're in violation of the court order. They're already in deep yogurt, and it'll get really deep if they thumb their noses at the courts.

Yeah I was thinking I should notify Colorado AG and I did look for their online fraud contact, but it seemed too general for this case.

The thing that bugs me about this guy, is that i've had GREAT service and prices from tons of online outdoor/climbing shops over the last year. And it's sad that this guy takes advantage of the goodwill created by all the other shops online...who are clearly trying to do good by us customers, both on prices and service and return etc.

Humbly, contact the judge directly. Rejecting court orders and fleeing to another state... they love that sort of behavior. Begging to get Federal action.

They haven't stopped.
They have relocated to Sweden.

Per hitta.se/olivier+goumas/arv…, they now live here:
41 år. Tingsstigen 11, 933 33 Arvidsjaur

and are continuing their scamming activities from there. Their server is probably located in the US.

They were behind grivel-us.com, a fake website pretending to represent grivel in the US, which has now luckily been shut down as well.

They are behind the ebay user 'grivel-us" ebay.ie/usr/grivel-us?_trks…, probably selling the rest of the merchandise the DA couldn't seize. First selling merchandise they really had in their possession to build great rating, then scam the rest of the buyers by luring them with their great rating.

They did the same thing with "summitwearhouse" on ebay until they racked up plenty of complaints and were shut down.
feedback.ebay.com/ws/eBayIS…

The address listed under grivel-us.com ( servicehostnet.com/domain/g…) is a fraud as well per sellercentral.amazon.com/fo….

Law enforcement should subpoena domain names records purchased by these crooks. I bet they have dozens of sites set up as e-commerce.

Bill Shubert · · Lexington, MA · Joined Jul 2012 · Points: 55

So they had a good 10 year run in the US before law enforcement took action, right? Presumably they're hoping to do the same in Sweden. There are enough countries that they can keep ripping people off for the rest of their lives at this rate. Is there anything that can be done to get them shut down faster? Taking down any US-operated servers will help, but it's not hard to get servers in other countries, so I'm worried it might only stop them for a week or so.

Funny, I was just wondering how these pieces of garbage were doing.

Rick Blair · · Denver · Joined Oct 2007 · Points: 266

Looks like they are almost at the Arctic Circle, must be ski areas nearby. Need to dig up the company name so I can warn my friends in Sweden. Sophia is from the South of Sweden so it is interesting they chose not to move there.

Feel real bad for the kids, they don't even know the Swedish language, just French and English.

Seeing that most swedes can speak English, they will probably be fine getting around as they learn Swedish.

Hopefully the parents will be eaten by bears.

They just recently registered grivel.us which is hosted by gandi sas, a french company. The alias used is Roberto Grivel, interesting change from Peggy..

In addition to grivel.us, they also own grivel-us.com (currently taken down)

www.grivel-us.com is now registered under "Roberto Champagne" AKA Roberto Grivel, AKA Peggy, AKA Boris at whining@123mountain.com, AKA Oliver Olivier Goumas....
