I am not an attorney, but I believe there are some around here to cover what isn't just fundamental reading of the rules.

RGold was right in saying that the right to photograph has limits.

In this case, the Preserve has prohibited drones for any purpose, so that would include prohibiting photography by drone. It has allowed that it will accept applications for exceptions for specific film or photo shoots.

As for public rights to photograph -- I believe they are limited in NYS. So, one would need to check NYS law to ensure what they were doing was legal, and to ensure that proper authorization was obtained -- for the photography and the use.

I am not sure of the limitations, but since we're talking about photographs taken by prohibited drones, I believe the photography by drone would definitely be prohibited at Mohonk. And I believe that if taken to court, the drone operator would not be the winning party in a suit.

As for the use of those photographs, I believe rights are limited in NYS. I believe there are specific exceptions, which include taking pictures of celebrities. If I am not a celebrity, I believe I may have the right to have removed from public view any photograph to which I have not consented.

I support the Mohonk Preserve in its policies and am grateful that rangers can deal with many of the worst offenses.

Unlike almost every other state, NY has no common-law privacy rights, there is no tort for invasion of privacy.

There is a statute protecting the use of an individual's image for commercial purposes w/o permission.

But if we're talking about breaking Preserve rules, then yes, the Preserve can throw you out.

Dude, you are wound way too tightly, and yeah - when someone is bashing people I have a great deal of respect for(each and every ranger with the MP), I am not about to stand by while that person talks shit.

The ranger's job description does not include being aware of each and every person who is on the lands and monitoring what they are doing. As I said, the DO range, on foot patrol and also in the various motorized vehicles, but there is just no possible way they can be everywhere at all times.

There's no need to keep repeating that you are not one who keeps their cell phone at the ready to post selfies to FB at each and every belay. We all read it the first time.

And I suppose I should include the information that yes, I do work there, as a seasonal Trailhead Assistant(one of those pesky people who wants to see your membership card when you enter, and no, doesn't remember each and every person by face and remember if their membership is current). I am also a caretaker at the Coxingkill, so if you ever head over for a dip in the stream after a day of climbing it's pretty likely you will run into me.

A word about the phones. I always have one in my pack, not so I can call in ranger strikes on drone pilots and unleashed dogs, but rather in order to communicate as rapidly as possible in an emergency. Moreover, with the advent of the Trapps and Near Trapps Apps, a phone is perhaps the best guidebook for the Trapps and the Northern part of the Nears. This means that even though NES commendably leaves his phone in the car (something I'd actually worry about a bit with summer temps), there are still going to be a very large number of parties at the cliffs with access to a cell phone, making HG's advice reasonable and broadly, if not universally, applicable.

This negative mentality and energy exhibited on the this thread is awful. I was just stoked that someone filmed me climbing one of the best climbs in the county and wanted to share it with my friends and family.

Yeah paying to climb sucks

yeah drones make noise

but as climbers we are so fortunate to have the skills, passion, and health to do ill shit outside that other people can only dream of!!

Why would you remove it? It serves a good purpose of informing folks about Preserve rules they may be unaware of, before they get in trouble. And you may still get your footage - the owner did post a reply but removed it, maybe after finding out he wasn't supposed to be flying and annoyed some climbers. I guess he didn't want to PM you though.

And why is it so negative to express opinions that you may not enjoy someone's antics? Maybe it is positive to point out to them and others they are violating the rules of a place that doesn't have to let them on their property?

this has served as space for grumpy rants...If you wanted to have a conversation about the rules and regulations perhaps you should start a new thread where everyone who wants to rant about rules, and how a drone ruined their day by flying around for 10mins can do so freely and be on topic.... which is a guideline for posting in these forums.
